Guilty until proven Innocent

Last week, the state of Arizona passed the most… for lack of a better word… Fascistic… anti illegal immigration law in the history of the United States, allowing police officers to ask for “proof of citizenship” of anyone they suspect is in the country illegally. And if that person can not produce such identification (ie: a birth certificate) right then and there, they can be hauled off to jail.

Think about all the American principles this violates. First, the standard for searching a person is “probable cause” not “reasonable suspicion“. You can’t just require a person to “produce evidence” based upon “the shoes they wear“. And more dramatically, arresting someone because they can’t produce their “papers, please”, deems EVERY person “guilty until PROVEN innocent” by producing proof of citizenship.

Incredibly, during the Fox “news” Sunday roundtable discussion last Sunday, Bret Hume said TWO amazing things. First, he called the Arizona law “draconian and likely unconstitutional”, and then in his next breath, called it “reasonable” for Arizona to have passed it because of the size of the problem they are having. You get that folks… under the right circumstances, “draconian and unconstitutional” is completely acceptable to Right-wingers.

During that same roundtable, co-lead-wingnut Bill Kristol… after calling himself “a Liberal when it comes to Civil Rights” (OMG)… defends the Arizona law, saying, “I don’t think it will violate anyone’s civil rights“. First, Bill, if you were really a “liberal when it comes to civil rights”, you’d know the standard isn’t whether you THINK a law MAY violate someones rights, the standard is whether it CAN. Only Conservatives are quick to sell out their principles and everything they claim to stand for when it becomes convenient to do so (eg: “deficits don’t matter” and “no nation building”.)

Later that same Sunday during the roundtable on ABC’s “This Week”, guest panelist Paul Krugman pointed out the utter hypocrisy of Tea Baggers, who are out there shouting every day about the over-reach of government power, yet are among some of the biggest supporters of the AZ anti-immigration bill. And while Krugman did allude to corporations “lik[ing] their cheap labor”, NO ONE on ANY of the Sunday shows suggested (as radio’s Thom Hartmann so frequently does) that the REAL problem is “illegal employers” attracting people to come here… and/or stay here illegally by providing them with jobs. It would be FAR more appropriate (and Constitutional) to crack down on companies hiring illegal immigrants than the immigrants themselves. Not only is it easier to enforce, but you don’t violate anyone’s civil rights to do it. You also eliminate a key incentive for attracting people to come here illegally or allows them to stay in the country illegally. (Kristol believes they are coming here because the U.S. is “the giant welfare state to the North” that… in Kristol’s fantasy-world… is providing non-citizens with free health care, cheap prescriptions, and Social Security checks.)

Bill “Liberal on civil rights” Kristol defended the AZ law by arguing that he doesn’t believes it will affect “that many people”, predicting that “the [worst] civil rights violation” would be someone “stopped perhaps on the street and asked to provide his driver’s license … that’s going to occur 5 times or 8 times or 13 times”. Not surprisingly, before the law had even passed, it has already claimed its first victim… an American-born Hispanic truck driver was ARRESTED when he was unable to produce his birth certificate after being stopped for driving while brown. As I predicted earlier, I don’t envision too many Norwegians being caught up in this dragnet.

The Arizona law does something no other law does in this country: it assumes guilt based upon mere suspicion by an individual and requires suspects to prove their innocence rather than lay the burden of guilt upon the prosecutor. It also targets an entire class of people for increased suspicion based solely upon appearance. We’ve already seen that in this country with black people. But if you go back in history, you will find NUMEROUS accounts of light-skinned blacks “passing” for other races: Italian, Arabic, Jewish, Spanish, etc… allowing some African-Americans to do things other “negros” could not at the time. (A famous 1959 movie entitled “Imitation of Life” was based on this premise).

And just as certain “light-skinned blacks” could avoid detection in early America, there are certainly “Hispanics that don’t look Hispanic” that won’t have to worry about being stopped by police and forced to “produce their papers” on command. I suspect we may soon see many more clean-shaven Mexicans with bleach-blond hair and wearing Polo shirts in the state of Arizona this year.

OKC bombing 15 years later. Comparing today’s hysteria to 1995.

Last week, at an event commemorating the 15th anniversary of the bombing of the “Murrah Federal Building” in Oklahoma City, former President Clinton compared the violent extremist rhetoric coming out of the “Tea Party” movement to the violent extremist rhetoric we heard coming out of the “militia” movement of the early 1990’s. Naturally, Republicans were aghast that anyone might suggest the teanuts were anything other than “benign” concerned citizens who are simply worried about the future of this country.

…of why this tiny group of extremely vocal Right-wing extremists are the breeding grounds for the same militaristic anti-government hysteria we saw in the 1990’s.

Naturally, hate-radio buffoon Rush Limbaugh denounced President Clinton for comparing today’s teanut vitriol to the same violent rhetoric on the 1990’s that led up to the OKC bombing, claiming (get this) that if some teanut commits an act of violence on the OKC anniversary, it will be HIS fault… because… you know… Bill Clinton has amazing hypnotic powers to make good people do bad things. <???>

Whatever. These people are so deep in denial that, even when confronted with physical proof of the kind of people their venom attracts, they try and claim that these people are “Left Wing infiltrators” that are simply there to make them look bad. I think I mentioned a few weeks back how, after several exchanges on YouTube with a teanut claiming “no one was spat upon” as members of the House filed in to vote on the Health Care Reform Bill, I finally shut my opponent down by “conceding”, “You’re right. You’ve convinced me that no tea bagger could be capable of such incivility right around the third time you called me a ‘lying, mother-f’ing, son-of-a-b!+ch’.”

I remember the Right-wing vitriol towards Bill Clinton from the day he took office (literally). He was already deemed “a pot-smoking draft dodger” (back before being a “drug-abusing draft dodger” became IOKIYAR) whose election was “illegitimate” due to receiving less than 50% of the vote (thanks to third-party candidate Ross Perot). But it was the FBI siege on the Branch Davidian “compound”, resulting in the accidental death (mass suicide?) of some 80 cult members including 20 children less than one month into Clinton’s presidency, that really kicked the militia movement into overdrive (I’ll spare you a recap of those 51 agonizing days), ending on April 19, 1993.

It was two years later in 1995 when a militant Davidian-sympathizer (who shall remain nameless) used the Waco siege as an excuse to bomb the “Murrah Federal Building” in Oklahoma City… home to one of two FBI headquarters responsible for the Waco siege in 1993 (the other in Dallas). The stated goal of this neo-nut was to trigger an armed rebellion by the people against the Federal Government. Just how do you get from “bombing a government building and killing scores of people” to “rallying support for an armed rebellion against the government”? The gameplan was laid out in a popular bit of anti-government paranoia-porn entitled “The Turner Diaries”, popular with the militia movement, where the government SO overreacts to an attack that they institute Martial Law and begin the oppression of ordinary citizens. The citizens then revolt to overthrow the government. These neo-nuts believed it was already happening… just not fast enough. So they decided to help things along by murdering 168 people including 20 children in a daycare center (20 children for 20 children? Coincidence? I’ll let you decide if they were deliberate targets or not.)

Today, the Militia movement is once again on the rise… fueled by both racism over the first black President, the “anti-Democrat” venom left over from the Clinton days, and a flood of corporate cash pumped into Conservative media (Right-wing radio, newspapers, and Fox “news”) spending hundreds of millions of dollars to convince “useful idiots” to work against their own best interests. The militia movement is simply a hyper-paranoid organized faction of the same anti-government hysteria feeding the teanuts. The proof that what I say is absolutely 100% right is the fact that everything these teanuts are decrying now took place on a far grander scale under President Bush (the deficit spending, the anti-Constitutional law breaking, infringement of civil liberties, economic collapse… and where were they? Oh yeah, calling us “unpatriotic” for not “supporting the president in a time of war”.)

If you have any doubt that the seething hatred and raw anger these people had for the Clinton Administration in the 1990’s was really as bad as described, I need only point out that TO THIS DAY, the Right STILL goes apoplectic at the sheer mention of the name “Clinton” (be it Bill or Hillary). Hell, these people still despise FDR, who died 20-30 years before most of them were even born. You’d think SOMEONE might have pointed out to these people that despite all the “end of the world”, “end of freedom”, “end to the American Way of Life” hysteria we heard from them going back decades… the country is still here. The greatest loss of “freedom”, “exploding deficits” and “massive expansion of government” came at the hands of their hero’s Ronald Reagan and George W. Bush… the latter of whom they are likewise unhappy with now, but for none of the reasons I just described. No, when teanuts are confronted with hard evidence of the failure of their politics, so deep is their denial, their natural instinct is to proclaim that person a member of the opposition… “Bush”, they now claim, “was a Liberal” (because he spent like Reagan). The Klansman at the Tea Party rally was “a Left-wing plant”, and profanity-spewing flame-throwers become enraged when accused of doing anything as “uncivil” as spitting upon a black Congressman.

Is the hysteria today as bad as it was in the 1990’s? Worse. Far worse, because we didn’t have the Right-wing media juggernaut that we have today ready to spend billions of dollars (now with approval from the Supreme Court) rallying already hysterical partisans into mainlining hate for breakfast, lunch & dinner. Do we need to fear another tragedy on April 19th? I expect not. The date no longer carry the same significance today that it did back then (not to mention it is Hitler’s birthday, and the teanuts have been trying… futilely… to disassociate themselves from the Obama=Nazi=Hitler crowd). But need we fear another slew of wingnuts flying planes into Federal Buildings or opening fire on the White House? You betcha!

If Obama were a Republican, they’d be singing his praises by now.

I am NOT one of those people that thinks President Obama is a “closet Republican”, nor a full-blown Conservative. I lump people who say things like that in the same group of Tea-nuts that call President Bush “a Liberal” (yes, those people really are out there), and those who, during the 2008 presidential campaign, called Obama “THE most Liberal Senator in Congress” (while serving along side Ted Kennedy). So when I say, “if Obama were a Republican, the GOP would be comparing him to Ronald Reagan”… it is not because he is like Reagan mind you, but because of all the things he has done that Conservative think they represent.

Newsweek’s Mike Dorning reported in an article last Friday:

“If Obama was a Republican, we would hear a never-ending drumbeat of news stories about markets voting in favor of the President.” – Dan Greenhaus, chief economic strategist for Miller Tabak + Co.

As the DOW is poised to break the 11,000 mark once again… up roughly 4,500 points since it bottomed out around 6,500 points in March of ’09… Republicans are in hysterics proclaiming the impending collapse of the once great United States of America.

Look at the list: He passed tax cuts despite being in the midst of two wars. The DOW has nearly doubled since bottoming out around 6,500 points thirteen months ago. The economy grew by 5.6% in the fourth quarter of last year… far better than most economists expected. Job-growth is heading towards positive territory, and he’s winding down (aka “winning” in Conservative-speak) the war in Iraq while ramping up the war in Afghanistan. He expanded crap-tastic “Romney-care” to the entire United States without a Public Option in sight (ThinkProgress has a fantastic list of PRAISE heaped upon Romney-care by the uber-Conservative Heritage Foundation, followed by quotes of them blasting “Obamacare” for doing the EXACT SAME THING), in a bill that mandates 30 million new customers to the Health Care Industry. He just signed a nuclear arms reduction treaty with Russia that continues St. Ronnie’s dream of “a nuclear free world”. He has continued many of President Bush’s most controversial extra-Constitutional policies, such as The Patriot Act, illegal wiretaps, and now strategic assassinations. And…

…who else but “The Party of Lincoln” could of brought us the first African-American president?

When Ronald Reagan took office in 1981, the economy was in miserable shape (following a trade-war with Russia where we embargoed grain over their support for Iran… devastating American farmers. And in return, Russia embargoed oil, devastating everything else) and unemployment was over 10%. Reagan then started deficit spending like there was no tomorrow (and, if you listened to his anti-Communist rhetoric, you’d be excused for thinking there wasn’t) and “rescued” the economy by strapping your grandchildren with a mountain of debt.

Yes, if President Obama were a Republican, the GOP would be comparing him (falsely) to The Gipper right about now. But they’re not. Instead, he is a “socialist, communist radical, hell-bent on destroying (what’s left of) the United States of America.”

In an interview on Fox “news” Sunday yesterday, Congresswoman Michelle “FEMA camps” Bachmann (R-Wingnuttia) proudly retracted her retraction after calling President Obama “anti-American” last year. She claimed that the U.S. government, “under Obama”, now “owns or controls 51% of the U.S. economy” due to the bailouts of Wall Street, and the “takeover” of the auto and health care industry.

Okay, first off, those three groups don’t account for 51% of the U.S. economy. Not even close. I can only guess she got that “51%” number the same place she gets all the rest of her delusional “facts”… from the equally delusional Glenn Beck. When you think of Boeing, Microsoft, Apple, Wal*Mart, McDonald’s, and the dozens of aerospace companies in the Military Industrial Complex (Grumman, McDonnell/Douglas, etc), not to mention all the Oil Companies (Exxon, et al), factory farms (eg: ADM) that make up the Fortune 500, a bunch of Wall Street brokerages and 30% of two car companies (remember, Ford decided it could survive without a loan from Uncle Sam)… and NONE of the Insurance companies (only in the cobweb infested recesses of Conservative minds does the Federal government “control” the health insurance companies), they barely account for even 8.33% of the U.S. economy ($1.5T in bailouts & stimulus divided by a 2009 GDP of $14T).

Second, if the “bailout of Wall Street” makes you “unAmerican”, then President Bush is the “unAmerican Socialist”, not Obama, since that took place under his watch, not Obama’s.

Living in Texas, I encounter Right-Wing nutters almost every day. Back in 2004, an old (very old) Republican argument from Clinton’s day resurfaced:

“EVERYBODY KNOWS that the presidents policies aren’t enacted until they leave office. Therefore, Bush Sr was responsible for the fantastic Clinton economy, and Clinton was responsible for the horrible Bush-43 economy.”

And now, we hear that same idiotic meme making a comeback. It is BUSH’S policies that are responsible for the positive economic growth we are now seeing under Obama. I enjoy pointing out to these pinheads that “if that’s the case, Carter is responsible for the economy under Reagan, and Reagan is responsible for the Recession under Bush-41.” That usually shuts them up quickly… though true zealots will go on to argue that something changed in the late 80’s so that the rule doesn’t apply before then. Riiiiiiight!

“Okay then, then there is NO WAY Obama could be responsible for “the Obama Recession” his first months in office, either, since things that happen on a Presidents watch are the result of policies enacted by his/her predecessor.”

Don’tcha just LOVE how the Republican mind works…. or doesn’t work as the case may be?

Massey Mine Disaster debunks Self-Regulating Free-Market Myth

You hear it all the time. Some self-proclaimed “Libertarian” or “Free-Market Republican” will argue against “government regulation” and insists that “corporations will always do what is in the best interests of the community because their survival depends upon it.” That’s the very cornerstone of “Free Market” ideology. Ron Paul built his political career upon it. If the mining disaster in West Virgina yesterday proves anything, it is that without government regulation, big business will skirt safety and gamble with peoples’ lives so long as the cost of the occasional disaster is less than the cost of prevention.

In the 1970’s, it was discovered that the Ford Motor Company had known of a problem with exploding gas tanks on their Ford Pinto for years, but had decided that it was cheaper to pay victims “hush money” than fix the problem. Ford did not fix the problem until the Federal Government found out in 1978, forcing them to recall over 1.5 million vehicles.

Reports of 600 safety violations at the Massey Mine in just the past 18 months are emerging. Yet, in 2008, one of Massey’s subsidiaries paid the largest fine in the history of the industry… $20 million dollars… for “clean water violations”, not safety violations.

Corporations are NOT benevolent entities that will always do the right thing out of survival. No, left on their own, corporations will cut every corner they can, so long as settling law suits is cheaper than enacting safety measures to prevent problems from happening again (or in the first place). And if there are no regulatory laws to break, on what basis would victims have to sue? But Tea-baggers and the GOP would have you believe that the solution to all our ills is “deregulation“.

Life & Limb aren’t the only things at risk with deregulation. I remind you of Wall Street and the banking bailout. They took ENORMOUS risks and gambled with the money of depositors and investors. They cratered the economy and sparked a global recession without concern for the consequences because 8 years of Republican deregulation let them do it.

So the next time you hear some brain-dead Tea Party zealot spouting their “less government” nonsense, simply point to Massey, the banks and Wall Street as examples of what happens when you let “the free market” take charge and let corporations run amok.

The following excellent viral email has been making the rounds for a few weeks now and deserves a link you can direct your friends to. The source of the original message is unknown. I have revised it slightly, corrected a few mistakes, added a couple of lines of my own, and added supporting links.

You didn’t get mad when the Supreme Court stopped a legal recount and appointed a President.

You didn’t get mad when Cheney allowed Energy company officials to dictate energy policy.

You didn’t get mad when a covert CIA operative was outed.

You didn’t get mad when the Patriot Act passed.

You didn’t get mad when we illegally invaded a country that posed no threat to us.

You didn’t get mad when we spent over $600 billion (and counting) on said illegal war.

You didn’t get mad when over $8.8 billion dollars just disappeared in Iraq.

You didn’t get mad when you saw the Abu Grahib photos.

You didn’t get mad when you found out we were torturing people.

You didn’t get mad when the government was illegally wiretapping Americans.

You didn’t get mad when the government suspended the Right of Heabeus Corpus to American citizens.

You didn’t get mad when we didn’t catch Bin Laden (or when the president said he was “truly not concerned about him” a mere SIX MONTHS after 9/11).

You didn’t get mad when you saw the horrible conditions at Walter Reed.

You didn’t get mad when we let a major US city drown.

You didn’t get mad when the National Debt DOUBLED in just six years to hit the ten trillion dollar mark.

No. You finally got mad when.. when… wait for it… when the government decided that people in America deserved the right to see a doctor if they get sick.
Yes, illegal wars, lies, corruption, torture, stealing your tax dollars to make the rich richer, are all okay with you but helping other Americans… well, that’s SOCIALISM!

April Fools? Obama opens drilling to draw GOP votes. Will he ever learn?

At first I thought, “This has to be an April Fool’s Day joke.” Last Wednesday, in a move that has infuriated environmentalists and most Democrats, President Obama announced that he would end a longstanding moratorium on offshore drilling off the South East coast and in Northern Alaska (red states) in advance of the upcoming vote on his Energy Bill.

According to the New York Times, the reasoning the president gave for lifting the moratorium is:

The proposal is intended to reduce dependence on oil imports, generate revenue from the sale of offshore leases and help win political support for comprehensive energy and climate legislation.

So President Obama thinks making devastating concessions to Republicans now will help secure Republican votes later? Where have I heard that before?

After bending over backwards to win GOP support for Health Care Reform and coming away with exactly ZERO Republican votes, one has to wonder what it will take for President Obama to stop making counter-productive concessions in order to win over votes that will never come? Senator John McCain vowed to “stop cooperating” with Democrats for the rest of the year in response to passage of the HCR bill. As both I and Bill Maher have pointed out, “You can’t threaten to stop cooperating if you never cooperated in the first place!”

(UPDATE: Republican Senator Lisa Murkowski (Alaska), when asked if opening Northern Alaska to offshore drilling would make her ‘more likely’ so support President Obama’s Energy Bill, Murkowski answered, “Absolutely not!”)

While Republicans complained that the Health Care Reform (HCR) bill that passed “contained NO Republican ideas”, it actually contained some 200 Republican changes, with NO Public Option just as they demanded. But when Republicans voted in lockstep against the bill, were those changes stripped out? No.

And now we are seeing it again. President Obama thinks he can buy GOP votes for his upcoming Energy Bill, which he plans inclusion of “Cap & Trade” and a “Carbon Tax” to limit greenhouse gasses… two programs Republicans are HIGHLY critical of, to the point where they CAMPAIGN on preventing them from ever passing, or their repeal should they pass.

So one must ask, if Republicans kick & scream over the President’s Energy Bill they way they did over HCR, and then vote in lockstep against it, will these dangerous and counter-productive concessions that only continue our dependence on oil and add to Global Warming will be stripped out should Republicans vote in lockstep once again against it?

Mr. President, if there is no threat of rescinding your concessions, then Republicans have NO incentive to cooperate in the future. It’s a Win-Win for them. You strip out the things they hate, and then they vote against the bill anyway. What incentive do they have to work with you the next time? Only the threat of stripping out the concessions you made to win their support if they vote against it will help win over those few votes.

And a topic for another day: We wouldn’t NEED to make such horrible sweeping changes to good legislation supported by 57-58 Senators simply to please two or three that threaten to filibuster, if we fixed the filibuster. Make them stand there and talk for hours like they did 50 years ago. Requiring a 60 vote super-majority to pass anything and everything in the Senate is unconstitutional.
